Thus the most ancient Barbarian code that has reached us—that of the Feini, or primitive Irish—in a fanciful quadripartite enumeration of the principles in force in levying fines, alludes to the responsibility of kindred—“And because there are four things for which it is levied: ‘cin’ (one’s own crime), and ‘tobhach’ (the crime of a near kinsman), ‘saighi’ (the crime of a middle kinsman), and the crime of a kinsman in general.”[15] A very complete example of the development of this system is to be found in the Icelandic legislation of the twelfth century, where the fines exacted diminish gradually, as far as the relatives in the fifth degree on both sides, each grade of the criminal’s family paying its rate to the corresponding grade of the sufferer’s kindred.[16] When, however, the next of kin were females, and were thus incompetent to prosecute for murder, the person who undertook that office was rewarded with one-third of the fine.[17] It was not until about 1270 that King Haco, in his unsuccessful attempt to reform these laws, ventured to decree that in cases of murder the blood-money should not be divided among the family of the victim, but should all be paid to the heir.[18] On the other hand, in Denmark, Eric VII., in 1269, relieved the kindred of the murderer from contributing to the _wer-gild_, although it continued to be divided among the relatives of the slain.[19] Among the Welsh the provisions for levying and distributing the fines were almost as complex as those of the early Icelandic law, one body of jurisprudence extending the liability even as far as sixth cousins;[20] and perhaps the quaintest expression of the responsibility of the kindred is to be found in the regulation that if any one should draw blood from the abbot of either of the seven great houses of Dyved, the offender should forfeit seven pounds, while a female of his kindred should become a washerwoman in token of disgrace.[21] The firm hold which this practical solidarity of the family had upon the jurisprudence of the European races is shown by a clause in the statutes of the city of Lille, as late as the fourteenth century, where the malefactor had the right to collect from his relatives a portion of the _wer-gild_ which he had incurred; and elaborate tables were drawn up, showing the amount payable by each relative in proportion to his degree of kinship, the liability extending as far as to third cousins.[22] A still more pregnant example of the responsibility of kindred is found in the customs of Aspres, in 1184, where the kindred of a homicide, if they would abjure him by oath on relics, were entitled to the public peace; but, if they refused to do so, it became the duty of the Count of Hainault, the Abbot of St. In saying that the laughter which accompanies tickling and other closely allied forms of play in children owes its value to its being an admirable way of announcing the friendly playful mood, I do not mean that other signs are absent. It involves the excitation of certain movements, and where these are not forthcoming we must infer, either that the sensory part of the process is defective, or that the motor impulse is inhibited in some way. And shall we bear in mind also that the reading public of a work of French fiction excludes in France the “young person” of whom the American library public is largely made up? On the one hand, librarians and libraries seem to be shy of religion. They also obtained from the chiefs a submission to the King of Spain; and I mention this early missionary expedition for the fact stated that each chief signed this act of submission “with a certain mark, like an autograph.” This document was subsequently taken to Spain by the celebrated Bishop Las Casas.[219] It is clear from the account that some definite form of signature was at that time in use among the chiefs. Who shall say that James Whitcomb Riley did not do just this when he chose to abandon the stock in trade of the standard poets and put into verse what he saw about him here in Indiana? It is a law of universal applicability that the strongest suggestion must prevail. Habit can be nothing but the impulsive force of certain physical impressions surviving in their ideas, and producing the same effects as the original impressions themselves. The essential condition of our laughter would thus appear to be, not the meeting of the amusing presentation with a state of complete unpreparedness of mind at the moment, but such a degree of contrariety between the presentation and our fixed and irrepressible apperceptive tendencies as will, even in spite of a pre-adjustment, secure something of a mild, momentary shock.[70] A more carefully developed example of the mode of conceiving of the laughable which finds its essence in the annihilation of a rational attitude is supplied by Schopenhauer. Another value they have in common with all the rest of the text of these books, and it is one which will be properly appreciated by any student of languages. At the suggestion of Senor Orozco, this able engineer ran a number of lines of construction to determine what had been the metrical standard of the builders. There is a softness in his style, proceeding from the tenderness of his heart: but his head is firm, and his hand is free. They differed, however, as to the weight of the indication which it afforded. As the opposition of contrasted sentiments heightens their vivacity, so the resemblance of those which immediately succeed each other renders them more faint and languid. He was the antithesis of a man of genius; and yet he did better, by mere dint of dulness, than many men of genius. The true book-lover wants to get at the soul of his book; the false one may never see it. The colonies enjoyed the privilege of the appeal of death, against the abrogation of which, in the province of Massachusetts Bay, Dunning protested so vehemently. These four classes of Sensations, therefore, having none of the qualities which are essential to, and inseparable from, the solid, external, and independent substances which excite them, cannot be qualities or modifications of those substances. But he will not have changed his character, any more than a man who sometimes lives in one apartment of a house and then takes possession of another, according to whim or convenience, changes his habitation.
